Judge rejects bid to deny permit for Robeson County sand mine

A Superior Court judge last week dismissed an appeal of a Robeson County Board of Commissioners decision granting a conditional use permit to mine sand in a community outside of Red Springs.

Judge Robert Floyd Jr. ruled in favor of the county's request dismissing the case on grounds that those appealing the commissioners' decision failed to include the permit holder as a respondent in the case, which is required by law.According to County Attorney Hal Kinlaw, Buie Lakes Plantation LLC - the corporation that received the permit on July 2, 2012 to mine sand on 125 acres along Buie-Philadelphus Road - should have been named among the respondents.Read more here.A Superior Court judge last week dismissed an appeal of a Robeson County Board of Commissioners decision granting a conditional use permit to mine sand in a community outside of Red Springs.
