Quanex Successful in Patent and Antitrust Suits against ATN Holdings

On November 6, 2014, a subsidiary of Quanex Building Products filed a lawsuit against ATN Holdings of California for infringement of five patents related to spacer and sealant assemblies, specifically its Quanex Duraseal® product line.

As of August 17, 2015, the lawsuit was dismissed with ATN agreeing to cease using and selling any product that violates Quanex’s patents.“We consider this settlement a victory in protecting the decades of experience and technical expertise that Quanex offers to the marketplace,” said Kevin Delaney, senior vice president, general counsel and secretary for Quanex Building Products. “We are committed to protecting our patents and other intellectual property globally and we have a zero-tolerance policy for those who attempt to unlawfully duplicate our innovations.”In addition, an Order of Dismissal with prejudice for the antitrust case ATN filed against Quanex was entered by the United States District Court, Central District of California.ATN also agreed to make a monetary payment to Quanex and Quanex agreed to withdraw the motion for Rule 11 sanctions it had filed against ATN.



Quanex retained Huang Ybarra Singer & May LLP of Los Angeles to protect its intellectual property interests and Munger Tolles & Olson LLP to assert its rights in the antitrust suit.
