Chemical and glass producer PPG Industries Inc. said it would appeal an award to privately held Marvin Windows and Doors by a federal jury here on Thursday.
Pittsburgh-based PPG, the world's largest maker of car and airplane paints, said it would appeal the $136 million awarded to Marvin, which claimed that PPG's PILT wood preservative failed to prevent rot in its wood windows manufactured during the late 1980s.PPG said the verdict was unexpected, adding the product had been in use for 20 years and continues to be used. The original suit, filed in April 1994, was thrown out in 1999. Marvin appealed the decision; the Eighth Circuit U.S. Court of Appeals dismissed 12 of 13 claims but allowed Marvin to move forward with a jury trial on a breach-of-warranty claim.
Shares of PPG were trading up 70 cents, or 1.45 percent at $49.01 in early trade on the New York Stock Exchange.
